Additional Rights for California Residents
California Consumer Privacy Act Notice
FuzeRx ("FuzeRx"), “Us”, “Our”, "We") provide this Privacy Policy to describe our practices in relation to personal information we collect from you through FuzeRx.com (the “Website”) and through offline means, such as when you interact with us on the phone or at in-person events (together with the Website, the “Services”).
This Privacy Policy does not apply to personal information we collect on behalf of our business customers, such as through our APIs that our business customers integrate into their online services, or to online services that we maintain but do not link to this Privacy Policy, such as our online careers portal.
If you are a business customer, we may collect additional information, which is subject to a separate agreement you have entered into with us.
This Privacy Policy also does not apply to our practices related to protected health information, as defined by the Health Insurance Portability and Accountability Act (HIPAA), which is covered by our separate Notice of HIPAA Privacy Practices.
This Privacy Policy describes our current practices and our practices for the 12 months preceding the “Last Updated” date.
As used in this Privacy Policy, “Personal Information” means any information that can be used to individually identify a person or household, and may include, but is not limited to, name, email address, postal or other physical address, title, and other information reasonably linkable to an individual or household with or without other identifying information in our possession. Personal Information also includes information relating to a person’s professional background, and may include, but is not limited to, resume, educational history, professional specialty, professional licenses and/or certifications, geographic areas of professional practice, legal claims relating to professional background, and years of professional experience.
Information You Provide to Us
We collect information you provide directly to us. For example, we collect information when you create an account, participate in any interactive features of the Services, fill out a form, request customer support, apply for a job with us, or otherwise communicate with us.
The types of information we may collect from you include:
Account Information: When you register for an account on our Services, you will need to provide us with certain Personal Information to complete the registration, including information that can be used to contact or identify you, which may include your name, email address, username, password, and phone number.
Health Information: We collect general health information from you regarding eligibility or diagnosis for treatment.
Insurance Information: We may collect information such as your bank identification number (BIN), processor control number (PCN) and cardholder ID.
Payment Information: We collect information regarding your payment methods including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
Other Information You Choose to Provide: We may collect additional information that you provide, such as when you request technical or customer support, communicate with us, or apply for a job with us.
Information We Collect When You Use the Services
When you access or use our Services, we automatically collect information about you, including:
Usage Information: We collect information about your activity on our Services. For example, we may collect routine information about how our site is used including pages viewed and server side events (i.e. API requests and responses).
Log Information: We may collect log information about your use of the Services, including the type of browser you use, access times, pages viewed and visited, and your IP address.
Information Collected by Cookies and Other Tracking Technologies: We and our service providers may use various technologies to collect information, including cookies and web beacons. Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experience, see which areas and features of our Services are popular, and count visits. Web beacons are electronic images that may be used on our Services or emails to help deliver cookies, count visits, and understand usage and campaign effectiveness. We may obtain information from other sources and use it as contemplated herein, including to provide the Services to and otherwise communicate with you.

Detect, investigate, and prevent fraudulent transactions and other illegal activities and protect the rights and property of FuzeRx and others; and
Carry out any other purpose for which the information was collected.
We also may use aggregated or de-identified information, which cannot reasonably be used to identify you, for various purposes, including, for example, to improve our automation and improve care. Once aggregated or de-identified, the data does not personally identify you, is no longer personal information, and is not subject to this Privacy Policy.
We may share information about you as follows or as otherwise described in this Privacy Policy:
With vendors, consultants and other service providers, including, but not limited to, hosting providers and payment processors, who need access to such information to carry out work on our behalf;
In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law, regulation or legal process;

If we believe your actions are inconsistent with our user agreements or policies, or to protect the rights, property and safety of FuzeRx or others;

We may also sell or share aggregated or de-identified information, which cannot reasonably be used to identify you.
Our Services may contain links to other web sites. Other web sites may also reference or link to our Services. These other web sites are not controlled by FuzeRx. We encourage our users to be aware when they leave our Services to read the privacy policies of each and every web site that collects personally identifiable information. We do not endorse, screen, or approve, and are not responsible for, the privacy practices or content of such other web sites or mobile applications. Visiting these other web sites is at your own risk.
We take reasonable measures to protect the personal information we obtain from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. However, the transmission of information via the internet is not completely secure. We cannot guarantee the security of your personal information transmitted through the Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy, data security, or technology-related related to the Website.
What is a Cookie?
A Cookie is a small piece of data that a Website – when visited by a user – asks your browser to store on your device e.g. computer, laptop, tablet or mobile phone, to remember preferences and other information, for example previous Website or page visits from that device and browser, username or login prompts, or other online behaviors.

Global Privacy Control
Global Privacy Control (GPC) is a specification designed to allow Internet users to notify businesses of their privacy preferences, such as whether or not they want their personal information to be sold or shared. It consists of a setting or extension in the user’s browser or mobile device and acts as a mechanism that Websites can use to indicate they support the specification.

At FuzeRx, we support and honor a Website user’s GPC request.
Do Not Track
Note that we do not currently respond to web browser “Do Not Track” signals that provide a method to opt out of the collection of information about online activities over time and across third-party Websites or online services because, among other reasons, there is no common definition of such signals and no industry-accepted standards for how such signals should be interpreted.
Google Analytics
We use Google Analytics to better understand your use of our Website and Services. Google Analytics collects information such as how often users visit our Website, what pages are visited, and what other sites may have been used prior to visiting.
Google uses the data collected to track and examine Website usage, to prepare reports on its activities and share them with other Google services, and to contextualize and personalize the ads of its own advertising network. Google’s ability to use and share information collected by Google Analytics about your visits to the Websites is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. Our Website is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Website. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on this Website or on or through any of its features/register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you are visiting the Website from outside the United States, you understand that your information may be transferred to, stored, and processed in the United States. The data protection and other laws of the United States might be different than those in your jurisdiction.
Account Information
You may update or correct certain information about you at any time by logging into your account or by emailing us at rx.support@fuzehealth.com. If you wish to deactivate your account, you may do so by reaching out to rx.privacy@fuzehealth.com, but note that we may retain certain information as required by law or for legitimate business purposes. We may also retain cached or archived copies of information about you for a certain period of time.
Promotional Communications
You may opt out of receiving promotional communications from us by following the instructions in those communications or by logging into your account. If you opt out, we may still send you non-promotional communications, such as those about your account or our ongoing business relations.
Your Privacy Rights
This section is applicable to residents of the USA. While certain states such as California, Colorado, Connecticut, Delaware, Indiana, Iowa, Montana, New Jersey, Oregon, Tennessee, Texas, Utah, Virginia and Washington may provide certain privacy rights detailed below, if you are a resident of any US state we will endeavor to honor and action reasonable requests you make in relation to your data privacy.

When you make a request, you can expect the following:
1. We will take steps to verify your identity and authority to make the request.
2. We will confirm our receipt of your request within 10 days. If you have not received a response within a few days after that, please let us know by contacting us.
3. We will respond to your request within a maximum of 45 days of receipt of the request, or shorter where required by law. If necessary, we may need an additional period of time and if we need an extension we will explain why.
4. In certain cases, a request may be denied, for example, if we cannot verify your identity or if providing you the information could create an unreasonable risk to someone’s security (for example, we do not want very sensitive information disclosed inappropriately). If we deny your request, we will explain why we denied it. If we deny a request, we will still try to provide you as much of the information as we can, but we will withhold the information subject to denial.
If you would like, you may designate an authorized individual or agent to make a request on your behalf. We will deny requests that do not evidence sufficient proof of authorization from you. To verify that an authorized individual or agent has authority to act for you, we may require a copy of a power of attorney or require that you provide the authorized agent with written permission and verify your own identity with us.
Depending on your state of residency you may have the following rights:
Access and Right to Know. This is the right to request a copy of your information that we process, or to request information about how your information is collected and who from, how it is used, who it is disclosed to and their contact information, for what business purpose it is collected, used, and disclosed, what specific pieces of data were collected, used and disclosed, and how your data is secured.
Correction. If you discover that we hold inaccurate information about you, you have a right to ask us to correct that information.
Erasure or Deletion. You have the right to request that we delete your information. We may refuse this request if the information is still necessary for the purposes that we collected or processed it or we still have a legal basis to process the information.
Restriction. You have the right, in some cases, to restrict or limit the processing or sharing of your information, such as where you have exercised your right to object and we are reviewing your objection.
Objection and Right to Opt Out of or Limit Sensitive Data Processing. You may have the right to object to us using your information for certain activities, and to opt out of or limit activities that involve processing of data defined as “Sensitive” under applicable U.S. state data privacy laws, such as health information. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where it is needed for legal reasons. Sensitive personal information includes information that reveals your social security, driver’s license, state identification card, or passport number; your account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; your precise geolocation; your racial or ethnic origin, religious or philosophical beliefs, or union membership; the contents of your mail, email, and text messages unless we are the intended recipient of the communication; your genetic data; the processing of biometric information for the purpose of uniquely identifying you; personal information collected and analyzed concerning your health; personal information collected and analyzed concerning your sex life or sexual orientation. We will only use your sensitive personal information to perform services reasonably expected by you.
Portability. You have the right in some cases to obtain a copy of your information in a format able to be shared with another organization.
Withdraw consent. If we are ever processing your information for an activity that you have consented to, you can withdraw your consent to processing at any time. Withdrawing your consent does not affect processing that has already occurred. Where you withdraw your consent, we will no longer process your information based on your consent. We may process your information if another legal basis applies, for example, if we are legally obligated to store certain records or if your withdrawal of consent was limited to certain processing activities.
Right to Opt Out of “Sale” or “Sharing” for Cross-Context Behavioral Advertising and other Specified Purposes. We do not engage in sale of your personal information for monetary consideration, but may share information for legitimate purposes described in this privacy policy. If an activity is ever considered a sale or sharing of personal information under a state privacy law’s definition, you may have the right to opt out of this to the extent we engage in it. Residents of certain states such as California, Colorado, Connecticut, Nevada, Utah and Virginia have rights to opt out of sale of personal information or sharing of personal information for cross-context behavioral advertising and other specified purposes, and of the use and/or disclosure of personal information for certain types of targeted advertising and consumer or household profiling. You may have the right to direct us not to process your personal information for purposes of (i) targeted advertising, (ii) selling or otherwise transferring personal information in exchange for monetary or other valuable consideration, or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. Nevada law also gives Nevada consumers the right to request that a company not sell their personal information for monetary consideration. This right applies even if their personal information is not currently being sold. If you are a Nevada consumer and wish to exercise this right, please send us an email with the subject line “Nevada Resident Do Not Sell Request”. In general, we will only use your personal information to perform our services reasonably expected by you, internal reporting and analytics purposes, for other legitimate business purposes such as information security. When you visit our websites, we may share information about your use of our websites with certain advertising or analytics partners. You can opt into, or out of, such sharing at any time by interacting with our cookie banner and Cookie Preferences center that may appear at the bottom of our websites the first time you come to our website, or the Cookie Preferences link that may appear in the footer of our websites. Right to opt out of the processing of the personal information for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects. Virginia and other U.S. residents may have a right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects.
Financial Incentives. The CCPA and other U.S. state data privacy laws allow businesses to offer consumers financial incentives for sharing personal information. For example, a business can offer a rewards program or provide a premium service to consumers as compensation for their personal information. If we offer these programs, your participation is optional. If you choose to participate, your participation will be subject to any applicable terms, and you may withdraw at any time.
Non-Discrimination and No Retaliation. If you exercise any of your privacy rights we will not discriminate or retaliate against you, including, but not limited to:
Complaint and Appeal. If you have a complaint regarding privacy, this policy or its implementation, or want to appeal against a decision made about you, we would appreciate the opportunity to try and resolve your issue. If we refuse to take action on any of the above rights, you can appeal this decision. Within 60 days or less of receipt of an appeal, we shall inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is unsuccessful and depending upon the state where you live, you may have the right to raise a concern or lodge a complaint with your state attorney general.
California “Shine the Light” Privacy Rights
California law permits our customers who are California residents to request certain information regarding the disclosure of certain personal information to third parties for their direct marketing purposes.
If we have disclosed any personal information to third parties for direct marketing purposes, we will provide a list of the categories of personal information, along with the names and addresses of these third parties to you at your request. To make such a request, write us at the postal address found in the Contact Information section of this Policy.
This request may be made no more than once per calendar year. We reserve our right not to respond to requests submitted other than to the specified email or postal address. You should put, "California Privacy Rights Direct Marketing" in the email subject line and in the body of your request. You must provide us with specific information regarding yourself so that we can accurately respond to the request.
California Minors Under 18
If you are a California resident under the age of 18 and are a registered user of our Online Services, you may request that we remove from our Online Services any content you post to our Online Services that can be accessed by any other user (whether registered or not). Please note that any content that is removed from visibility on our Online Services may still remain on our servers and in our systems. To request removal of content under this provision, please write or email us at the postal or email address found in the Contact Information section of this Policy. When you write to us, please provide us with a description of the content and the location of the content on our Online Services, along with any other information that we may require to consider your request. Your Rights
You have the right to request that we disclose certain information to you about our collection and use of your PI over the preceding twelve (12) months prior to your request. Once we receive and confirm your verifiable consumer request, we will disclose to you:

You have the right to request that we delete any PI about you that we have. Applicable law may require or permit us to decline your request. If we decline your request, we will tell you why.

Our responses to any of your requests for the information described above will be limited to information that we have collected in the preceding twelve (12) months before our receipt of your verified request. You will receive our response to your request within 45 days of your request, unless we provide you with notice that it will take more than 45 days to respond (in that case, we won’t take more than 90 days to respond).
We will review this policy annually and update it from time to time. Any changes will be posted on this page and will become effective as of the “Last Revised” date. We encourage you to review this policy periodically to be sure you are aware of those changes.
